By using Present For Me, you agree to be bound by these Terms of Service. These terms apply to the use of the web app, the iOS app, and any other related service offered by the platform.

If you do not accept these terms, please do not use the platform.

The Privacy Policy and Cookie Policy, available on their respective pages, form an integral part of these terms.

Present For Me is a free platform for creating and sharing wishlists. Key features include:

• Wishlists: create unlimited wish lists with gifts from any source
• Gift reservations: secret and anonymous gift booking by friends and family
• Group gifts: share the cost of a gift among multiple people
• Events: organize events (birthday, Christmas, wedding, etc.) with participant management
• Secret Santa: automatic anonymous drawing for gift exchanges
• Gamification: points system, badges, and leaderboard among friends
• Referral program: invite friends and earn points for the birthday lottery
• UGC Gallery: share photos and videos of received gifts (Gift Wrapped)
• iOS App: native access with push notifications

The service is offered free of charge, with no subscriptions or hidden costs. We reserve the right to modify, update, or suspend individual features at any time.

To use the service, you must create an account. Requirements and responsibilities:

• Minimum age: you must be at least 16 years old to create an account (consistent with our Privacy Policy, section 10)
• Accurate information: provide truthful and up-to-date data during registration
• Valid email: use a valid, non-disposable email address
• Secure password: minimum 8 characters, including at least one uppercase letter, one number, and one special character
• Security: you are responsible for the security of your account and password
• Temporary lockout: after 5 failed login attempts, the account is locked for 15 minutes
• One account per person: creating multiple accounts or sharing credentials is not permitted

The core functionality of the platform is wishlist management:

• You can create unlimited wishlists with gifts from any source (Amazon, online stores, physical products)
• Sharing is done via a unique link that can be enabled or disabled at any time
• Reservations are secret: whoever reserves a gift remains anonymous to the wishlist owner
• Only one active reservation per gift is allowed at a time
• Gift comments are limited to 500 characters
• Gift images must be in PNG, JPEG, WebP, or GIF format, with a maximum size of 10 MB

Important: the platform does not handle financial transactions between users. The purchase and delivery of gifts take place outside of Present For Me.

The group gift feature (Share Request) allows sharing the cost of a gift among multiple people:

• Requests can involve a minimum of 2 and a maximum of 20 participants
• Only friends can participate in a share request
• The gift must not already be reserved by another user
• Each share request has a time limit (deadline)
• Completion occurs automatically when the minimum number of participants is reached
• The gift owner cannot participate in the share request

The platform allows organizing events with integrated wishlists:

• Event types: birthday, Christmas, wedding, anniversary, baby shower, graduation, Secret Santa, other
• Invitations can be sent via link or email
• For Secret Santa: a minimum of 3 participants is required and the drawing is automatic and random
• The Secret Santa drawing can be performed only once per event

The platform is not responsible for the quality, delivery, or value of gifts exchanged during events.

Present For Me includes a gamification system to enhance the user experience:

• Santa Score: points system based on actions within the platform
• Badges: achievements with progressive levels (bronze, silver, gold)
• Leaderboard: ranking among friends based on score
• Birthday lottery: on your birthday, the platform selects who will receive a gift based on tickets earned through referrals and milestones

Important: points, badges, and tickets have no monetary value and are non-transferable. The platform reserves the right to modify the points system at any time. There are no vested rights to prizes or lotteries.

Each account has a unique referral code for inviting new users:

• 2 points for each friend who signs up through your referral link
• Milestone bonuses: +5 points (5 friends), +15 points (10 friends), +50 points (25 friends)
• Referral points contribute to tickets for the birthday lottery

The following is strictly prohibited:

• Sending spam or unsolicited communications to promote your link
• Creating multiple accounts to accumulate referral points
• Manipulating the referral system in any way

The platform reserves the right to revoke points obtained through abusive practices and to suspend the accounts involved.

The Gift Wrapped feature allows users to upload photos and videos of received gifts:

• Accepted formats: PNG, JPEG, WebP, GIF, MP4, QuickTime, WebM
• Maximum size: 100 MB per file
• Captions: maximum 500 characters
• Moderation: content is subject to approval before publication in the gallery

Ownership and license: users retain ownership of uploaded content but grant Present For Me a non-exclusive, royalty-free, worldwide license to display and distribute such content within the service.

Prohibited content: uploading offensive, illegal, pornographic, violent, or rights-infringing material is forbidden. The platform may remove content without prior notice.

Present For Me participates in commercial affiliate programs:

• Product links may contain affiliate tags (e.g., Amazon Associates)
• The platform performs click tracking on links to partner sites
• Users are informed that links may generate commissions for the platform
• Product prices are not affected by the affiliate tag

The platform is not responsible for purchases made on third-party sites, product availability, or sales conditions applied by retailers.

Present For Me offers a native iOS app with the same features as the website:

• The app requires device registration for push notification delivery via APNs (Apple Push Notification service) tokens
• Push notifications can be revoked at any time from the device settings
• Mobile authentication uses API tokens, revocable from account settings
• The platform collects device data (model, OS version, app version) as described in the Privacy Policy

By using Present For Me, you agree not to:

• Use the service for illegal, fraudulent, or deceptive purposes
• Send spam, unsolicited communications, or unauthorized promotional content
• Upload malware, viruses, or malicious code
• Attempt unauthorized access to systems, data, or other users' accounts
• Abuse the platform's APIs or services
• Create multiple accounts to manipulate gamification, referral, or lottery systems
• Upload offensive, discriminatory, pornographic, or violent content
• Harass, intimidate, or impersonate other users

The platform applies rate limiting on APIs to prevent abuse and may suspend or terminate accounts that violate these rules, without notice and without right to refund.

The Present For Me brand, design, source code, and all platform materials are the exclusive property of the creator.

Your content: you retain full ownership of content you upload (lists, descriptions, images, comments). You grant the platform a limited license to display and distribute such content solely within the service.

It is forbidden to copy, modify, reproduce, or distribute the platform's code, design, or content without written authorization.

The processing of personal data is governed by our Privacy Policy. Cookie usage is governed by our Cookie Policy. Both policies are available on their respective pages and form an integral part of these terms.

Your GDPR rights (access, rectification, erasure, portability, objection) can be exercised as described in the Privacy Policy.

The service is provided "as is" and "as available", without warranties of any kind, express or implied.

Present For Me is not responsible for:

• Temporary service unavailability or technical interruptions
• Data loss due to malfunctions
• Financial transactions between users (gift purchase and delivery)
• User-uploaded content (photos, videos, descriptions)
• Products purchased through affiliate links on third-party sites
• Results of automated decisions (gamification, lottery, Secret Santa drawing)
• External links and third-party websites

The platform's liability is limited to proven direct damages. Force majeure events are excluded.

You can delete your account at any time from your profile settings.

Consequences of deletion: deletion is permanent and irreversible. The following will be permanently removed:

• All gifts and wishlists
• Friendships and friend requests
• Event participations and drawings
• Notifications, API tokens, and device registrations
• Support tickets and messages
• Points, badges, and lottery tickets

Timeline: complete removal from backups occurs within 30 days of deletion.

Platform-initiated deletion: we reserve the right to delete accounts inactive for more than 24 months (with email notice and 30 days' advance warning) or accounts that violate these terms (without notice).

We reserve the right to modify these terms at any time. Changes will be communicated through:

• Visible notice on the platform
• Email to the address associated with your account
• Push notification (if you have the app installed and notifications enabled)

Continued use of the platform after changes are published constitutes acceptance of the new terms.

For substantial changes, at least 30 days' notice will be provided before they take effect.

These terms are governed by Italian law.

Competent court: for any dispute, the competent court shall be determined according to applicable regulations. For consumers, the court of the consumer's place of residence shall have jurisdiction.

Before taking any legal action, the parties commit to an amicable resolution attempt. For online dispute resolution, the European Commission's ODR platform is available: https://ec.europa.eu/consumers/odr.
